PROBLEMS OF STAGING OF CRIMINALISTIC ACTIVITY IN THE CONTEXT OF SITUATIONAL APPROACH

The purpose of work is the research of problematic issues of the criminalistic staging which is one of methods of the organization of investigation of crimes. As the methodological basis the circumstance consisting in dialectic interrelation of staging and a situatsionnost of the criminalistic activity which is carried out by the investigator is chosen. The received results allow to structure more precisely the criminalistic activity which is carried out in pre-judicial production, to define time frames and the maintenance of each of its stages and also their situational characteristics acting as a basis of versionny activity. In the doctrinal plan the conclusions which are contained in work can be used at further conceptualization of a private criminalistic technique. Correctly, taking into account qualitative content, will call the system of the investigative situations developing in pre-judicial production: investigative situations of a stage of verification of the message about crime; investigative situations of an initial stage of investigation of crime; investigative situations of the subsequent stage of investigation of crime. The following provisions act as the main conclusions: 1. The continuity of criminalistic provisions of staging with provisions of a criminalistic situalogiya gains the nature of a peculiar methodological sheaf which use allows to conduct equally a successful research in each of the called spheres of criminalistic knowledge. 2. It is necessary to understand qualitatively certain part of the search cognitive activity directed to a research of the circumstances demonstrating commission of crime, which is characterized by specific subjects and also the purposes and tasks predetermined by an investigative situation, and carried out by means of the system of the actions inherent in this part of criminalistic activity as a stage of criminalistic activity. 3. Depending on a qualitative originality of the investigative situations developing in pre-judicial production they exist as investigative situations of a stage of verification of the message about crime; investigative situations of an initial stage of investigation of crime and investigative situations of the subsequent stage of investigation of crime. Depending on dynamics of investigative situations it is necessary to say that that on each of the called stages there is an initial investigative situation, a situation of its development and the finishing investigative situation indicating the termination of this or that stage of criminalistic activity. 4. Each subsequent stage in the situational plan begins after on it separate investigative actions are carried out and at the same time the evidence is obtained or already available proofs found confirmation.
