摘要
The present paper aims to discussing the protection and preservation of mata Atlantica, Brazil's national heritage, by means of legal and economic mechanisms, in special, by Environmental Reserve Quota. The legal regime of the mata Atlantica protection can be combined with institutes provided for by Forest Code in favor of environmental preservation effectiveness. The Forest Code and the Federal Law 11.428/2006 regulate Forest Legal Reserve as environmentally protected area. The Law make possible the excess area to the Legal Forest Reserve is converted to Environmental Reserve Quota. The Environmental Reserve Quota study shows the great potential of mechanism to increase the protection of mata Atlantica and promote an effective culture of sustainability. The theoretical frameworks that support and subsidize the conclusions reached are in agreement on environmental law expansive line. Therefore, the effectiveness of environmental law is considered within the context of background understanding of legal institutions. The paper takes on a critical methodological analysis in favor of effectiveness of Environmental Reserve Quota.
