摘要
This article aims to discuss about the formation of the Brazilian domain administrative framework. In this sense, we will seek to demonstrate briefly how the conceptions of Elite and Estate influenced - from Portugal - the construction of the (patrimonial) State and the colonial, republican and democratic institutions in Brazil. At the end, we will treat in this work about the legacy that such conceptions have left to the Brazilian constitutionalist movement, especially with regard to the processes of ruptures and discontinuities in the affirmation of the Democratic State.
