Private Arbitration and Regulatory Adjudication in the Telecommunications Industry The New Balance Between Private and Public Interests

The scope of this article is to analyse the relationship between private arbitration and regulatory adjudication in the changing context of the telecommunications industry.(1) One particular aim is to show that, while the distinction between private and public dispute resolution is lessening, the two systems increasingly tend to interact, which makes it necessary to redefine the respective roles of regulatory adjudicators and arbitrators.
