摘要
What responses has the law to claims of minorities who advocate a deconstruction of subjectivity and put into question the assumptions objective data of the materiality of a body? Is there, for example, a correlation between seemingly emancipatory possibilities of a theory of performativity and the language of law? On this basis, this paper will deepen the role played by fictions in law and the paths that can move a non-reprentational theory of language, contrary to the neo-positivists sought to find a language capable of describing reality as it is, when thinking a legal system more inclusive and open to new challenges that complex contemporary societies demand.
