摘要
The paper examines the legal strategy driven by presidential candidate Raul Alfonsin to deal with violations of human rights committed in Argentina by its last military dictatorship (1976-1983). On the one hand, I examine the political premises of this proposal and its links with a particular perspective on the history of political violence in the country. On the other hand, I analyses its links with the political struggles waged in the context of its development during the political transition from military dictatorship to democracy. Finally, I present the legal affiliations of the strategy with the theoretical models that dominate internationally in the eighties of the twentieth century to think and judge extermination processes. The article will seek to show how the strategy Alfonsin to judge the principal perpetrators of human rights violations sought to address the ethical duty to do justice to these violations and, simultaneously, the aim of preserving democracy and ensuring human rights present and future. This dual objective, it is proposed, it was the origin of the dilemmas and tensions faced by this proposal.
