摘要：
We summarized the views on the obstacles in the spread of mediation and possible measures for its development in Russia, expressed in Russian literature. We found that different and sometimes conflicting opinions and advice on mediation development in Russia, are expressed. We revealed that the attention is paid to these issues primarily by researchers from legal and related science, but opinions rationale derives from empirical experience and/or substantiated theoretical, often legal hypotheses and designs. We found that the fundamental scientific studies and surveys, justifying certain proposals, are virtually absent. We conclude that successful mediation development and building confidence to the new institution needs the measures aimed at development of mediation to be based on research evidence supporting the effectiveness of mediation for the settlement of certain disputes.
