摘要：

In this article it is based that the research of constitutional blanks and conflicts becoming apparent in the legal system currently in force is the necessary condition and requisite for shaping of legal constitutional regime. At the same time it is necessary to apprehend the Constitution in all it's real, not idealized qualities, reflecting contradictoriness of it's genetic, ontological and axiological (normative legal) features. In many respects the essential beginnings of the Constitution predetermine the basic backgrounds of contradictions and conflicts in normative legal substance of the Basic Law and legal system in whole, what outwardly, on the formal juridical constitutional level, becomes apparent in the form of blanks, collisions, defects of legal regulation. The special significance in its overcoming belongs to the organs of the judicial constitutional control and in connection with this the problems of overcoming of constitutional conflict blanks and contradictoriness of legal regulation in practice of the Constitutional Court of the Russian Federation are analyzed.
