CONCEPTUAL IDEAS OF REFORMING OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

The article reveals current trends of international, national and regional crime activity development. Its threatening increase leads to necessity for immediate steps to be taken by the international community, regional organizations and states. Russian legislator tries to respond to threats and challenges of the criminal world by means of new criminal regulations development. The author mentions certain disbalance and contradiction in criminal law regulations and even violation of international, constitutional and criminal legal principles of human rights and freedoms adherence. The author suggests developing a new edition of the Criminal Code. The new edition would be based on reforming in accordance to criminal law principles provided by Articles 3-8 of the Criminal Code of the Russian Federation. Those principles include: legal order, citizens legal equality; justice and humanism. All the criminal regulations of both General and Special part need to be considered according to these principles: those regulations on criminal law, on crime, on penalty, from crimes against person to crimes against peace and personal security. The suggested reforming will allow changing the Criminal Code in accordance to the unified rules, eliminating many contradictions and excessive collisions. The collisions to be eliminated were mostly caused by random, unreasonable and constant changes and amendments. The suggested concept is aimed at turning the Criminal Code of the Russian Federation into a Uniform act of consistent criminal legal regulations corresponding to international criminal law, the Constitution of the Russian Federation and applicable for real crime counteraction. New criminal law development and adoption will save the unified criminal laws and support its further development.
