Gaps in criminal regulation of entrepreneurial relations

This paper deals with lacunae in criminal law regulation of relationship in the sphere of entrepreneurial activity. Scientists' opinions on lacunae criteria in law regulating are given. The author specifies a few lacunae for criminal law regulating and offers some ways of their overcoming. Legislative fixation of such entrepreneurial crime criteria as << large-scale damage >> and << illegal income >>; insertion of << criminal minor offence >> into criminal law in the capacity of an important legal means to restrain continuous extension of criminal responsibility; fundamental revision of the key concepts such as << entrepreneurial >> and << banking >> activities and legislative fixation of their alteration are offered. Some suggestions are made about introducing new corpora delicti of entrepreneurial crimes, stipulated in RF PC Articles 1712, 1713, 1714 and aimed at providing effective defense of relationship in the sphere of entrepreneurial activity, into the Penal Code of Russian Federation.
