Fundamental Rights and Family Private International Law

This paper focuses on the relationship between family private international law and respect for individual rights to private and family life. While considering the relevant international and national case-law practice, it illustrates as a starting point how the recognition of foreign judgments discipline can adversely affect these fundamental rights. The paper in essence intends to conceptualize the legal foundations underlying a human rights based perspective of recognising foreign judgments and public acts.
