摘要
The scope of this article is to present the open society of interpreters drawn up by Peter Haberle and also to demonstrate the need for effective participation of the components of a pluralistic society in legal process that debate matters of collective scope, which suggests a remake of legal education, in order to demonstrate the importance of this participation in a democratic plan. The work goes through the origin, concept and positivation and main aspects of the institute of the amicus curiae brief in the New Civil Procedure Code and in the finally, seeks to expose the influence and enlargement of the open society of Haberle on the institute of the court friend.
