THE CORRELATION BETWEEN THE METHODS AND PURPOSES OF THE CIVIL RIGHT PROTECTION

The article is devoted to the study of necessary amendments to the legal provisions about ways to protect civil rights contained in article 12 of the Civil code of the Russian Federation. To date, the legislator does not contain a legal definition of the purpose of protection of civil rights. However, as contained in article 12 of the Civil code of the Russian Federation, the list of ways to protect, according to the authors, is not quite correct. In particular, the list contains an indication of the ways of protection, as restoring the situation that existed before the violation of rights, and prevent actions which violate the right or create the threat of such a violation. The authors of the argument inexpediency of the consolidation of such ways of protection, an assumption is made about the use of the specified categories of the term "the purpose of protection of rights". Accordingly, shows the ratio of the method and purpose of protection of civil rights. The conditions for the protection of civil rights, analyzed provisions of existing procedural laws in this sphere. The authors also considered whether the legislative consolidation of article 12 of the Civil code of the Russian Federation General the list of methods for protection. Proposal about the exclusion from the specified article of the provisions of that application are only means provided by the law.
