摘要：

The proposal for an analogical hermeneutics, backed by equity and prudence, allows for a dialogue between opposing theoretical positions that at first sight seem irreconcilable. It is in this way that the possibility of an exchange of views is established in order to reach a solution that satisfies to opposing parties. Said resolution is shown when is applied in human rights perspectives in the positivism normativity and alternatives to the law. For this, it takes the case of the ownership of knowledge.
