Is there Hegelian Philosophy in the Criminal Law of the Enemy? Distances between Gunther Jakobs and Hegel's law philosophy

摘要
In this article we seek to review some key concepts of the Enemy Criminal Law theory developed by Gunther Jakobs using some key concepts found in Hegel's Philosophy of Law. By doing so, we wish to analyze the supposed Hegelian roots of the theoretical construct built by the German jurist. We exercise this analysis taking in account a detailed review of Hegel's Philosophy of Law (1821), but with some interpretational guidelines found in The Phenomenology of Spirit (1807). We will focus on the concepts of person, enemy, society, law and state found in the theory of Jakobs. And like a mirrored game, we make a comparative and analytical analysis of these concepts using the Hegelian categories of subject, abstract formal law, ethical state and rationality.
